Accurate Flood Zone Determination

These Terms & Conditions (“Terms”) govern access to and use of the website, reports, portals, tools, downloads, and any related services provided by Accurate Flood Zone Determination (“Accurate Flood Zone Determination,” “we,” “us,” or “our”) (collectively, the “Services”). By accessing or using the Services, you agree to these Terms.
If you are using the Services on behalf of a bank, lender, servicer, correspondent, insurer, vendor, or other organization (“Organization”), you represent and warrant that you have authority to bind that Organization to these Terms, and “you” includes the Organization.
1) Scope of Services
Accurate Flood Zone Determination provides flood zone determination and related compliance support services for mortgage and lending workflows. Depending on your use case, the Services may include:
• flood zone determination results and related reporting fields;
• mapping-based or data-driven research to support determinations;
• integrations, file uploads/downloads, portals, or delivery methods used in operational workflows; and
• customer support related to ordering, delivery, and exception handling.
2) Eligibility and Intended Users (B2B Only)
The Services are intended for business use by Organizations and their authorized personnel. The Services are not marketed or designed for consumer/personal household use.
You are responsible for ensuring that your use of the Services complies with your internal policies and applicable law (including privacy and information security requirements).
3) Accounts and Security
If an account is provided:
• You must keep login credentials confidential and restrict access to authorized personnel.
• You are responsible for all activity conducted through your account (including activity by your employees, agents, contractors, or vendors you permit to access the account).
• You must notify Accurate Flood Zone Determination promptly of any suspected unauthorized access.
Accurate Flood Zone Determination may suspend access to protect the Services, your account, or other users if Accurate Flood Zone Determination detects misuse, abnormal activity, or security risk.
4) Your Inputs and Authorization
Many Services require you to submit property and/or loan-related information (for example, property address, borrower/loan identifiers, internal reference numbers, or transaction metadata) (“Inputs”).
You represent and warrant that:
• you have the legal right and appropriate authority to provide the Inputs to Accurate Flood Zone Determination for the purposes of obtaining the Services; and
• the Inputs you provide are accurate to the best of your knowledge and suitable for the operational purpose you intend.
5) Outputs, Operational Use, and Decision Responsibility
The Services may produce determinations, status fields, map references, and related compliance outputs (“Outputs”). Outputs are intended to support organizational workflows.
You acknowledge that:
• Accurate Flood Zone Determination does not provide legal advice, insurance advice, underwriting decisions, or financial advice;
• your Organization remains responsible for decisions made using Outputs, including decisions related to lending, compliance, insurance, escrow, servicing, or customer communications; and
• Outputs may depend on the completeness/quality of Inputs and the availability/limitations of relevant sources and datasets.
6) No “Consumer Reporting” Use; No FCRA Use (Optional)
Unless you have a separate written agreement with Accurate Flood Zone Determination that explicitly states otherwise, you agree that you will not use the Services or Outputs as a “consumer report” or for any purpose regulated under the Fair Credit Reporting Act (FCRA) or similar consumer reporting laws.
7) Acceptable Use
You agree not to:
• access or use the Services in any unlawful manner;
• attempt to bypass security controls, probe or test vulnerabilities, or gain unauthorized access;
• interfere with system integrity (malware, exploitation attempts, denial-of-service behavior, excessive automated requests that degrade performance, etc.);
• reverse engineer, decompile, or attempt to extract source code except where such restriction is prohibited by law; or
• use the Services to infringe intellectual property rights or violate privacy rights.
8) Privacy and Confidentiality
Your use of the Services is subject to Accurate Flood Zone Determination’s Privacy Policy (if published on the website). Where applicable, Accurate Flood Zone Determination will handle information consistent with Accurate Flood Zone Determination’s Privacy Policy and reasonable security practices.
Because the Services are used in business workflows, you are responsible for meeting your own obligations relating to:
• privacy notices and disclosures to your customers/borrowers (as applicable);
• obtaining consents or providing required notices (as applicable);
• maintaining appropriate information security and access controls; and
• minimizing the data you submit to what is necessary for the Services.
9) Third-Party Services and Links
The Services may integrate with or link to third-party platforms, tools, or websites. Third parties are not controlled by Accurate Flood Zone Determination, and your use of third-party services is governed by their terms. Accurate Flood Zone Determination is not responsible for third-party content or practices.
10) Intellectual Property
Accurate Flood Zone Determination (and/or its licensors) owns all rights, title, and interest in the Services, including software, site content, workflows, and report formats. No rights are granted except as expressly stated in these Terms.
Subject to these Terms, you may use Outputs internally for legitimate business and compliance workflows. You may not resell, sublicense, or distribute Outputs externally except:
• as required for your transaction workflow (e.g., to an investor, insurer, regulator, or authorized counterparty), or
• as expressly permitted in a separate written agreement with Accurate Flood Zone Determination.
11) Disclaimers
THE SERVICES AND OUTPUTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, TO THE MAXIMUM EXTENT PERMITTED BY LAW. ACCURATE FLOOD ZONE DETERMINATION DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
No method or dataset can guarantee error-free results in every case. Inputs, matching logic, mapping sources, and exception conditions can affect outcomes.
12) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
• ACCURATE FLOOD ZONE DETERMINATION WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY.
• ACCURATE FLOOD ZONE DETERMINATION’S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT PAID BY YOU (IF ANY) TO ACCURATE FLOOD ZONE DETERMINATION FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations; in those jurisdictions, liability will be limited to the greatest extent permitted by law.
13) Indemnification
You agree to defend, indemnify, and hold harmless Accurate Flood Zone Determination and its affiliates, officers, directors, employees, and contractors from and against claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising from:
• your misuse of the Services;
• your violation of these Terms; or
• your violation of any law or third-party rights (including privacy or intellectual property rights).
14) Suspension and Termination
Accurate Flood Zone Determination may suspend or terminate access to the Services if Accurate Flood Zone Determination reasonably believes:
• you have violated these Terms;
• your use creates security risk, operational risk, or legal exposure; or
• suspension/termination is necessary to comply with law or legal process.
Sections that by their nature should survive will survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, and Indemnification).
15) Changes to These Terms
Accurate Flood Zone Determination may update these Terms from time to time. The “Effective Date” indicates when these Terms were last updated. Continued use of the Services after an update constitutes acceptance of the updated Terms.
16) Governing Law and Dispute Resolution
These Terms will be governed by applicable law. Any dispute arising out of or relating to these Terms or the Services will be brought in a court of competent jurisdiction, unless the parties agree in writing to an alternative dispute process.
